{"id":8690,"date":"2013-02-19T10:18:09","date_gmt":"2013-02-19T10:18:09","guid":{"rendered":"https:\/\/drugprevent.org.uk\/ppp\/?p=8690"},"modified":"2013-02-19T10:18:09","modified_gmt":"2013-02-19T10:18:09","slug":"pot-stays-illegal-in-canada-after-appeal-court-upholds-medical-marijuana-laws","status":"publish","type":"post","link":"https:\/\/drugprevent.org.uk\/ppp\/2013\/02\/pot-stays-illegal-in-canada-after-appeal-court-upholds-medical-marijuana-laws\/","title":{"rendered":"Pot Stays Illegal in Canada After Appeal Court Upholds Medical Marijuana Laws"},"content":{"rendered":"<p><span style=\"font-size: 10pt; font-family: Verdana;\"><br \/>\nCanada&#8217;s ban on marijuana was effectively upheld Friday when Ontario&#8217;s top court struck down the country&#8217;s laws related to medicinal pot much to the chagrin of activist groups. <\/p>\n<p>In overturning a lower court ruling, the Court of Appeal ruled the trial judge had made numerous errors in striking down the country&#8217;s medical pot laws. <\/p>\n<p>Among other things, the Appeal Court found the judge was wrong to interpret an earlier ruling as creating a constitutional right to use medical marijuana. <\/p>\n<p>&#8220;Given that marijuana can medically benefit some individuals, a blanket criminal prohibition on its use is unconstitutional,&#8221; the Appeal Court said. <\/p>\n<p>&#8220;(However), this court did not hold that serious illness gives rise to an automatic right to use marijuana.&#8221; <\/p>\n<p>Currently, doctors are allowed to exempt patients from the ban on marijuana, but many physicians have refused to prescribe the drug on the grounds its benefits are not scientifically proven. <\/p>\n<p>The Canadian HIV\/AIDS Legal Network called the decision a disappointing missed opportunity. <\/p>\n<p><em>Source:  The Canadian Press &#8211; Friday, February 1 2013<br \/>\n<\/em><\/p>\n<p><\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Canada&#8217;s ban on marijuana was effectively upheld Friday when Ontario&#8217;s top court struck down the country&#8217;s laws related to medicinal pot much to the chagrin of activist groups.
